Any order under a product appearing in the online store site TEDDYFISH.fr (SELLER SITE) requires consultation and prior acceptance of these terms and conditions of sale. The click of the confirmation of the order implies full acceptance of these terms. The click has the value of "digital signature"

SUBJECT

These Conditions of Sale are intended to define the rights and obligations of the parties in connection with the online sale of goods offered by the SELLER to the consumer.

ORDERING

Ordering options :
TEDDYFISH products are available for purchase 24/7 through our online store. Unless noted otherwise, items are in stock and available for shipment once order has been processed. If items are backordered or delayed, we will contact you via email or phone with the shipment date.

Order verification :
You will receive an email confirmation of your order once it has been placed. You will receive a second email confirming shipment of your order. This email will include a tracking number that can be used to track the status of your delivery.

Payment options :
TEDDYFISH.fr exclusively accept all payment from Paypal account.

Proof of the transaction :
The records, kept in computer systems company SELLER under reasonable conditions of safety are considered proof of communications, orders and payments between the parties.The filing of purchase orders and invoices is made on a reliable and durable backup media and can be produced as evidence

Product information :
All efforts have been made to ensure the accuracy of information presented on the SELLER SITE. The SELLER or its suppliers are however not responsible for the consequences, incidental, and special damages arising from electronic transmission or the accuracy of information transmitted even in cases where the SELLER was aware of the possibility of such damages. The names and product brands and manufacturers are used only for identification purposes. The pictures, descriptions and prices are not contractual.

SHIPPING

Delivery method :
Most of the products for sale online are in-stock and send by Hong Kong Speedpost services, which assures 4 to 8 business days delivery time for worldwide. If products are not available in stock or available to meet shipping requirements, you will be contacted via email.

Problem of delivery because the carrier :
All products leave our premises in perfect condition. Therefore, any anomaly concerning the delivery (damage, missing product compared to the delivery order, damaged package, broken product ...) must be indicated on the delivery form under the form of handwritten reservation, accompanied by the signature of the client.

The consumer must confirm this problem by sending the carrier within two (2) business days following the date of delivery registered mail with return receipt stating those claims.

The consumer must send a copy of this mail to the address of the SELLER. Without this, we proceed to any exchange.

Delivery errors :
The consumer must make to the SELLER, the day of delivery or later than the first business day after delivery, any claim of error of delivery and / or non-conformity of goods in kind or in quality compared to entries on the order form. Beyond this period, all claims will be rejected.

The formulation of this claim to the SELLER may be made to the address of the SELLER.

Any claim not made in the rules defined above and within the time limits could not be taken into account and will release the SELLER of any responsibility towards the consumer.

In case of error of delivery or exchange any product for exchange or refund will be returned to the SELLER as a whole and in its original packaging in perfect condition to the address of the SELLER.

To be accepted, any return will be reported and have the consent of the SELLER, which if agreed will ship the package to the right place.

The shipping costs shall be borne by the SELLER, except where it is confirmed that the product does not match the original declaration made by the consumer in the good sense of return.

CUSTOMS & TAX

Teddyfish cannot determine in advanced the amount of customs charges, taxes or duties that may be incurred, if any. Customers are advised to check with their local customs office(s) to ascertain whether any additional charges will be incurred prior to placing any order.

RETURNS AND EXCHANGES POLICY

EUROPEAN UNION (EU) RETURNS: If you are based in the EU, we will honour the Consumer Protection (Distance Selling) Regulations. This gives you the right to cancel your order and obtain a full refund within 7 days of receipt of the item(s); we will, however, withhold shipping costs. Notice of contract cancellation under these regulations must be given in writing to: Notice of Contract Cancellation, TEDDYFISH COMPANY, RM10 17/F Wing Hing Industrial Bldg. 83-93 Chai Wan Kok Street Tsuen Wan Hong Kong.

NON-EU RETURNS: If you are based elsewhere, where items are returned in accordance with the returns policy below, a refund will be provided (which will exclude shipping costs and custom fees).

Credits are refunded upon receipt of the item via the original method of purchase. Typically, refunds are reflected on your statements within 3-5 business days. Refunded credits do not include shipping costs and custom fees. You will be notified via email once the return is processed.

Return Policy
If you are unhappy with any item that you have purchased from us online, you may return it to us within 7 days of receipt. Items must be returned unused, with all tags attached and with the reason for its unsatisfactory..

Items must be returned in saleable condition. Returns that are damaged, soiled or show evidence of having been worn, may be refused and returned to the customer.

Exchange
If you wish to exchange an item, please return the original item and in writing state the full item number and description of the original item and the new item sought. Exchanges are subject to stock and availability.

Repair
Every bag of Teddyfish is 100% handmade in our own studio, therefore we hope that the owner can use the bag long enough for it to need repair. Please contact us if you need any repairing service, we will reply you as soon as possible for the instruction.

Events outside control:
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (a“Force Majeure Event”).

A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes (without limitation) the following: strikes, lock-outs or other industrial action; civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war; fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster; impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport; impossibility of the use of public or private telecommunications networks; the acts, decrees, legislation, regulations or restrictions of any government.

Our performance under any contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the contract may be performed despite the

APPLICABLE LAW

The Terms & Conditions together with all our policies and procedures will be governed by and construed in accordance the relevant HKSAR law and the relevant courts of the HKSAR will have exclusive jurisdiction..

We reserve the right to: Modify or withdraw, temporarily or permanently, this Website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website.

Use of this Site constitutes your agreement to be bound by and to act in accordance with these Terms. Teddyfish Co. reserves the right to change the Terms at anytime. Any such changes will be posted on this Site and you agree to be bound by such changes.

No partial validation :
If any provision of these Terms are held to be invalidated or declared such under any law, regulation or following a final decision of a competent court, other provisions shall remains in full force and scope.

No waiver :
The fact that one party did not claim a breach by the other party to any obligations contained in the framework of these general conditions of sale cannot be interpreted in the future as a claim the obligation in question.

COPYRIGHTS, TRADE MARKS, USE OF CONTENT AND MATERIALS

Your use of the Website grants no rights to you in relation to copyright, design rights, trade marks or other of our intellectual property rights. We provide the Website to you solely for your personal, non-commercial use. The content of the Website may not be used for any other purpose without our express written permission.
